1. Acceptance of Terms

By accessing or using CrossPollen, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Mottoz USA LLC.

2. Eligibility

You must be at least 18 years old to use CrossPollen. By using the Service, you represent and warrant that:

• You are 18 years of age or older.
• You have the legal capacity to enter into a binding agreement.
• You are not barred from using the Service under the laws of your jurisdiction.
• All information you provide is accurate, current, and complete.

3. User Account

To use CrossPollen, you must create an account. You agree to:

• Provide accurate and complete information when registering.
• Maintain the confidentiality of your password and credentials.
• Be solely responsible for all activity that occurs under your account.
• Notify us immediately of any unauthorized use of your account at crosspollen@mottoz.com.

We reserve the right to suspend or terminate accounts that contain false information, impersonate others, or are used in violation of these Terms.

4. User Conduct and Prohibited Content

You agree not to use the Service to post, share, upload, transmit, or otherwise make available any content that:

• Is offensive, harassing, defamatory, obscene, hateful, threatening, sexually explicit, violent, discriminatory, or otherwise objectionable.
• Infringes any patent, trademark, trade secret, copyright, or other intellectual property rights of any party.
• Is unlawful, fraudulent, deceptive, or promotes illegal activity.
• Contains spam, chain letters, pyramid schemes, or unauthorized advertising or solicitations.
• Contains viruses, malware, or other harmful code.
• Impersonates any person or entity or misrepresents your affiliation with a person or entity.
• Exploits or endangers minors, or contains child sexual abuse material (CSAM).

You also agree not to: harass, stalk, threaten, or abuse other users; collect or harvest information about other users without their consent; interfere with or disrupt the Service; attempt to gain unauthorized access to any part of the Service; or use the Service in any way that violates applicable laws or regulations.

6. Moderation Policy

We use a combination of user reporting, automated filters, and human review to moderate content and behavior on CrossPollen. Our moderation process includes:

• In-app reporting: Every profile, message, and piece of user-generated content includes a clear “Report” option.
• In-app blocking: You can block any user at any time, which prevents them from contacting you or appearing in your matches.
• 24-hour response: We commit to reviewing every report and taking action within 24 hours.
• Enforcement actions: Depending on severity, actions include content removal, warnings, temporary suspension, or permanent account termination (ejection).
• No appeals for severe violations: Accounts terminated for CSAM, hate speech, threats of violence, or repeated harassment are not eligible for reinstatement.

To report content or a user, use the in-app Report button or email crosspollen@mottoz.com.

7. Termination

We may suspend, restrict, or terminate your account and access to the Service at any time, with or without notice, for any reason, including but not limited to a violation of these Terms. Upon termination:

• Your right to use the Service ceases immediately.
• We may delete your account data, subject to our retention obligations under applicable law and our Privacy Policy.
• Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.

You may terminate your account at any time by contacting crosspollen@mottoz.com or through the in-app account deletion option.

8. Intellectual Property

The Service and all of its content, features, and functionality (including but not limited to text, graphics, logos, icons, images, audio, software, and the CrossPollen name and bee mark) are owned by Mottoz USA LLC and are protected by United States and international copyright, trademark, and other intellectual property laws.

Your content: You retain ownership of the content you submit to CrossPollen. By submitting content, you grant Mottoz USA LLC a worldwide, non-exclusive, royalty-free, sublicensable license to use, host, store, reproduce, modify, display, and distribute that content solely for the purpose of operating and improving the Service.

You may not copy, modify, distribute, sell, lease, or reverse engineer any portion of the Service without our prior written consent.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, MOTTOZ USA LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Service will be uninterrupted, secure, or error-free; that defects will be corrected; that matches generated by our algorithm will result in any specific business or personal outcome; or that any content shared by other users is accurate, reliable, or appropriate.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MOTTOZ USA LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of those courts.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page and, for material changes, provide notice within the app. Your continued use of the Service after the changes become effective constitutes your acceptance of the revised Terms.
